amgcoaching provides professional, personal, executive and education coaching and mentoring services (Services) in the form of face to face, remote and online sessions and training workshops. These Terms & Conditions apply to all coaching and mentoring services provided through amgcoaching.

Terms

Client – any individual who enters into a contract to purchase coaching services – you can only purchase Services from amgcoaching if you are eligible to enter into a contract and are at least 18 years old.

Coach / Supervisor – Dr Anna Marie Gilliland

Contract/Coaching Agreement/Supervision Agreement – a legally-binding agreement between the Client and amgcoaching for the supply of Services. It is your responsibility to ensure that any information or specification you provide is accurate.

Services – includes all Services advertised on the Website, brochures, or other forms of advertisement. All Services are subject to availability.

Description of Coaching – coaching is a working collaboration (not a legal business partnership) between the Coach and the Client. It is designed to support the Client in developing personal, professional or educational goals and facilitate the creation of strategies to meet those goals. It is a non-therapeutic intervention intended for individuals who wish to reflect on, re-consider, develop, change or enhance professional or personal situations.

Client/Coach Relationship

The Coach agrees to maintain the ethics and standards of behaviour established by the European Mentoring and Coaching Council (EMCC) and Global Code of Ethics for Coaches, Mentors and Supervisors (www.globalcodeofethics.org).

The Client is solely responsible for creating and implementing any decisions, choices and actions resulting from engaging in any coaching Services as provided by amgcoaching. The Client agrees that the Coach is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any Services provided by the Coach.

The Client understands coaching is not a therapeutic intervention and cannot act as a substitute for therapy. Coaching does not prevent, cure, or treat mental disorder or medical disease. The Client also acknowledges that coaching does not involve diagnosis or treatment of mental disorders and is not to be used as a substitute for counselling or other types of mental health care. It is the Client’s responsibility to seek independent professional guidance as needed.

The Client acknowledges that coaching is a holistic process, involving different areas of life (work, finances, health, relationships, education, and recreation). The Client maintains exclusive responsibility with regards all issues.

Personal Information

We retain and use all information strictly under the Privacy Policy.

Contact may be made using e-mail or other electronic communication methods and you expressly agree to this.

Confidentiality

Use of the website is governed by our Privacy Policy (which is incorporated into these Terms and Conditions by this reference).

All information (documented or verbal) that the Client shares with the Coach as part of the coaching relationship is bound by the principles of confidentiality set forth in the EMCC Code of Ethics. However, all Clients should be aware that coaching is not considered a legally confidential relationship such as in the medical and legal professions. Therefore, communications are not subject to the protection of any legally recognised privilege. The Coach agrees not to disclose any information pertaining to the Client or unless the Client has provided written consent. The Coach agrees not to disclose the name of the Client as a reference without written consent from the Client.

Confidential Information does not include information that: (a) was known to the Coach prior to disclosure by the Client; (b) is available and known within the public domain; (c) is obtained by the Coach from a third party (without breach of any obligation to the Client); (d) the Coach is required by law to disclose; and (e) as a result of disclosure the Coach reasonably believes there to be imminent or likely risk of danger or harm to the Client or others. The Client also acknowledges their on-going responsibility to raise any confidentiality questions or concerns with the Coach in a timely manner.

Booking

Coaching sessions (number, duration & location) booked through the website will be mutually determined by Coach and Client prior to any coaching Services being provided. Booking of sessions is only confirmed on receipt of full advance payment for sessions (individual sessions or packages). Descriptions of Services on our website do not constitute a contractual offer to sell such Services. All Services are subject to availability of the Coach.

Limited Liability

The Coach makes no guarantees, representations or warranties of any kind, express or implied, with respect to coaching Services agreed upon and received by the Client. In no event shall the Coach be liable to the Client for any indirect, consequential, or special damages.
